These Terms are governed by the laws of the Republic of South Africa, and you submit to the jurisdiction of the South African courts.
Effective for customers on qualifying Easy2Access Managed Hosting or Dedicated Server plans.
We guarantee that our network will be available 99.9% of the time in any given month, excluding scheduled maintenance. This means you should not experience more than 43 minutes of network downtime in any calendar month, counted from the first day. Network uptime includes all core infrastructure, including routers, switches, firewalls, and cabling, but excludes services or software running on your self-managed server or hardware.
If network uptime is less than 99.9% (i.e., downtime exceeds 43 minutes in a given month), you may request a credit of 5% of the base monthly fee for every 30 minutes of confirmed downtime, up to 100% of your monthly fee for the affected service.
Service credits will not be issued for downtime attributable to:
Degradation outside our control (e.g., tier-1 upstream provider outages);
Scheduled maintenance (announced in advance);
Force majeure events (e.g., acts of God, war, civil unrest);
Distributed Denial of Service (DDoS) attacks against your server;
Negligent acts or omissions by the customer.
We must receive the credit request within 48 hours of the downtime reporting incident. We will confirm the network unavailability according to our internal monitoring systems before issuing any credits.
